Terms of Service

These terms cover two things: general use of this website, and the standard terms that apply when you engage me for development work. Specific projects are further governed by a signed agreement (like a Memorandum of Understanding or contract) between us, which takes precedence over the general terms below where they differ.

1. Website Use

This site and its content are provided for informational purposes about CrossPlatformDev's services. You may browse, read, and contact me freely. Content on this site (text, design, code snippets shown as examples) may not be copied or reused for commercial purposes without permission.

2. Project Engagements — General Terms

When you hire me for a website, mobile app, or business system, the following generally applies unless a specific written agreement says otherwise:

Scope of Work

Every project starts with an agreed scope — what's being built, the technologies used, and what's included. Changes outside that scope may involve additional cost and timeline, discussed before any extra work begins.

Payment

Projects are typically paid in staged deposits tied to milestones (e.g. 25% at key project stages — database/login setup, core interface completion, project completion, and final hosting/launch), rather than one lump sum. Exact payment terms are set per project and confirmed in writing before work begins. Accepted payment methods include e-transfer and cash.

Third-Party Costs

Costs for domains, hosting, and any required third-party APIs are separate from the development fee and are the client's responsibility, paid either directly to the provider or reimbursed to me if I set them up on your behalf.

Client Responsibilities

Clients are expected to provide necessary materials on time — content, product data, images, business information, and access to accounts needed to complete the project. Delays in providing these may extend the project timeline accordingly.

Ownership

Upon full and final payment, ownership of the custom code developed for your project transfers to you. Reusable components, frameworks, or general-purpose tools I've built independently remain mine and may be reused in future projects.

Revisions & Support

Reasonable revisions during development are included as part of the agreed scope. Ongoing support, feature additions, or maintenance after launch are available separately and discussed per project.

Project Timelines

Timelines are estimates based on the agreed scope and assume timely client feedback and materials. Delays caused by the client (late content, slow feedback, scope changes) may extend the delivery date.

Cancellation

If a client becomes unresponsive for an extended period (generally two weeks or more) without communication, the project may be considered paused or ended without refund of deposits already paid for completed work.

3. Confidentiality

Any confidential business information shared during a project — trade secrets, business plans, financial details, or client data — is kept confidential during and after our working relationship, and is not disclosed to third parties without consent.

4. Limitation of Liability

I build software carefully and test before delivery, but I'm not liable for indirect losses, lost profits, or damages arising from use of the delivered software beyond the fees paid for the project. Clients are responsible for maintaining their own backups and reviewing delivered work before relying on it in production.

5. Dispute Resolution

If a disagreement arises during a project, both parties agree to first attempt to resolve it through direct discussion and mutual agreement before pursuing other remedies.

6. Governing Law

These terms are governed by the laws of Ontario, Canada.
